1. Agreement to these Terms
These Terms & Conditions (“Terms”) govern your access to and use of the FutureBaby mobile application, website, and related services (together, the “Services”). The Services are operated by GLOW HOLISTIC MOTHER CARE PTY LTD (ABN 45 678 824 194) (“FutureBaby”, “we”, “us”, or “our”).
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 13 years old, and at least the minimum age required in your country, to use the Services. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You may not use the Services if doing so would breach applicable law or if we have previously suspended or terminated your access for misuse.
3. What FutureBaby provides
FutureBaby is a creative entertainment tool that uses artificial intelligence to generate a fictional baby portrait based on photos and preferences you submit. Features may include generating, viewing, saving, and sharing images.
AI output is probabilistic and may vary. We do not guarantee that a result will resemble any person, meet your expectations, or be unique. We may add, change, suspend, or discontinue features to maintain or improve the Services.
4. Entertainment-only disclaimer
FutureBaby does not perform genetic analysis and cannot predict the real appearance, sex, gender, health, ancestry, inherited traits, or other characteristics of a current or future child. Generated images are synthetic artwork and should not be treated as factual.
The Services do not provide medical, fertility, family-planning, genetic, or psychological advice. Do not rely on any output when making health, reproductive, legal, financial, or other important decisions. Seek advice from an appropriately qualified professional when needed.
5. Your photos and content
You retain the rights you hold in photos, prompts, and other content you submit (“Input”). You grant us a limited, worldwide, non-exclusive licence to host, copy, transmit, process, and modify your Input only as reasonably necessary to operate, secure, and improve the Services and generate your requested output.
You are responsible for your Input and confirm that:
- you own it or have all permissions needed to submit and process it;
- each identifiable person shown has consented, or you otherwise have lawful authority to use their image;
- where a child appears, you are their parent or legal guardian or have clear permission from one; and
- your Input and use of the output will not violate any law or another person’s rights.
Subject to applicable law and third-party rights, you may use and share your generated output for personal, lawful purposes. Because AI systems can create similar output for different users, we cannot promise that output is exclusive or eligible for intellectual-property protection.
6. Purchases and subscriptions
Some features may require credits, a one-time purchase, or a subscription. Prices, included features, billing periods, trial conditions, and renewal details are shown before purchase.
Automatic renewal
If you purchase an auto-renewing subscription, it continues and you are charged at the disclosed interval until you cancel. Cancel through the Apple App Store, Google Play, or the payment provider used for your purchase. Deleting the app does not cancel a subscription.
Trials and promotions
A trial or promotional offer may be limited to eligible users. Unless cancelled before the disclosed deadline, a trial may convert to a paid subscription at the price shown when you started it.
Refunds
Purchases made through an app store are subject to that store’s billing and refund rules. For purchases made directly from us, contact [email protected]. Nothing in these Terms limits rights you cannot waive under applicable consumer law, including the Australian Consumer Law.
7. Acceptable use
You must not use the Services to:
- create unlawful, exploitative, pornographic, abusive, harassing, hateful, deceptive, or defamatory material;
- sexualise, exploit, impersonate, or endanger a child or any other person;
- create deceptive content intended to mislead others about a real person, pregnancy, parentage, identity, or event;
- upload photos without the rights and permissions described in these Terms;
- reverse engineer, scrape, overload, interfere with, or bypass security or access controls;
- use automated means to access the Services except where we expressly permit it; or
- resell, sublicense, or commercially exploit the Services without our written permission.
We may remove content, limit generations, or suspend access where we reasonably believe these Terms, the law, or another person’s rights have been violated.
8. Our intellectual property
We and our licensors own the Services, including the software, brand, design, text, graphics, and underlying technology, excluding your Input. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Services for personal, non-commercial purposes in accordance with these Terms.
Feedback you voluntarily send may be used by us without restriction or compensation, provided we do not identify you publicly without permission.
9. Privacy
Our Privacy Policy explains how we handle photos, generated content, device information, purchases, and other personal information. By using the Services, you acknowledge those practices.
10. Third-party services
The Services may rely on or link to third parties, including app stores, payment processors, cloud providers, and AI service providers. Their separate terms and policies may apply. We are not responsible for third-party services that we do not control.
11. Suspension and termination
You may stop using FutureBaby at any time. We may suspend or terminate access if you materially breach these Terms, create risk or harm, fail to pay amounts due, or if required by law. Where reasonable, we will provide notice and an opportunity to address the issue.
Provisions that by their nature should survive termination—including ownership, disclaimers, limits of liability, and dispute provisions—will remain in effect.
12. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available”. We do not guarantee uninterrupted availability, error-free operation, permanent storage, or that output will be accurate, appropriate, unique, or suitable for a particular purpose.
AI systems can produce unexpected, inaccurate, or objectionable output. You are responsible for reviewing generated content before saving, publishing, or sharing it.
13. Limitation of liability
Nothing in these Terms excludes or limits any guarantee, warranty, right, or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
To the extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive loss, loss of data, loss of opportunity, or loss arising from reliance on generated output. Where our liability cannot be excluded but may be limited, it is limited to resupplying the affected Services or the amount you paid for them in the 12 months before the event giving rise to the claim, whichever is greater.
14. Governing law
These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them. Mandatory consumer rights and local laws in your place of residence continue to apply.
15. Changes to these Terms
We may update these Terms to reflect changes to the Services, law, or our practices. We will post the updated Terms and change the “Last updated” date. If a change is material, we will provide reasonable additional notice where required.
