Nook – Terms & Conditions (Web to App)

These Terms & Conditions ("Terms") govern your access to and use of: (a) our website pages, landing pages, checkout pages, QR destinations, and deep links (the "Website"); and (b) the Nook mobile application (the "App") and related services (together, the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Who we are
The Services are operated by GLOW HOLISTIC MOTHER CARE PTY LTD (ABN 45 678 824 194) ("we", "us", "our").

2. Eligibility
The Services are intended for adults. You should be 18 years or older to use the Services. If you use the Services on behalf of someone else, you confirm you have authority to do so.
3. Important: Not a medical app (no medical advice)
Nook is not a medical app or medical device. It provides general wellbeing, educational, and self-reflective support only. It does not provide medical advice, diagnosis, treatment, clinical monitoring, or emergency services.
You should not use Nook as a substitute for professional medical advice, diagnosis, treatment, or crisis support. Always seek advice from a qualified healthcare professional for any health concerns, including mental health, pregnancy, postpartum, or parenting-related concerns.
Emergency: If you believe you may be at risk of harming yourself or others, or you are in immediate danger, call your local emergency number immediately (000 in Australia) or go to the nearest emergency department.
4. Web-to-app flow and deep links
We may provide QR codes, buttons, links, and prompts that:
- direct you to download the App from the Apple App Store or Google Play Store;
- open the App if it is already installed (deep links); or
- take you to specific pages in the App after installation.
Your use of the Apple App Store and Google Play Store is governed by their own terms and policies.
5. Accounts
To access parts of the Services, you may need to create an account. You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.
6. Purchases, billing & access
We offer Paid Features, including:
- Monthly subscription (recurring); and
- Lifetime access (one-off purchase).
6.1 Where you can buy
- Website purchase (Stripe): You may purchase via the Website using Stripe ("Stripe Purchase").
- In-app purchase (Apple/Google): You may purchase via Apple App Store or Google Play billing ("Platform Purchase").
6.2 Subscriptions
Subscriptions renew automatically unless cancelled before the renewal date, depending on the payment method used:
- Stripe subscription: managed through your account or by contacting us.
- Apple/Google subscription: managed through your Apple ID / App Store settings or Google Play subscription settings.
6.3 Immediate loss of access on cancellation / refund
If you cancel a subscription or receive a refund for a Paid Feature, your access to that Paid Feature may end immediately (including access in the App).
7. 30-day money-back guarantee (Lifetime – Stripe only)
We offer a 30-day money-back guarantee for Lifetime access purchases made via the Website through Stripe only ("Guarantee"), subject to the terms below. The 30-day period starts from the purchase date.
7.1 What the Guarantee covers
- Applies to Lifetime access purchased via Stripe on the Website.
- Does not apply to monthly subscriptions.
7.2 Exclusions
The Guarantee does not apply if:
- you have already received a refund before for any Nook purchase on the same account (or where we reasonably believe it is the same user);
- the Lifetime purchase was made via Apple App Store or Google Play (Platform Purchases are controlled by Apple/Google refund rules);
- we reasonably suspect fraud, abuse, chargeback abuse, or repeated refund behaviour.
7.3 How to request a Guarantee refund
Email [email protected] within 30 days of purchase with:
- the email address used for your Nook account;
- proof of purchase / Stripe receipt details (or last 4 digits / transaction reference if available); and
- an optional reason for requesting the refund (optional).
7.4 What happens after approval
- If approved, we will refund the original payment method used for the Stripe Purchase.
- Your Lifetime access will end immediately after the refund is processed/approved (and access may be removed earlier to prevent abuse).
8. Platform purchases (Apple / Google) and refunds
If you purchase through Apple App Store or Google Play, the platform generally controls billing and refund decisions. We may not be able to issue refunds for Platform Purchases directly. If you request help, we can point you to the platform's refund process where applicable.
Important: The 30-day money-back guarantee in Section 7 does not apply to Platform Purchases.
9. Privacy & data collected in the web-to-app flow
We collect limited information to provide the Services. In the web-to-app flow, this may include:
- Email address; and
- Motherhood stage (e.g. pregnant, newborn, postpartum, toddler).

10. Acceptable use
You agree you will not:
- use the Services unlawfully or in a way that harms others;
- attempt to hack, disrupt, reverse engineer, or bypass security;
- scrape or harvest data from the Services without permission;
- upload or transmit malicious code;
- misuse support channels (spam, harassment, threats).
11. Intellectual property
We own (or license) all intellectual property in the Services, including the App, Website, content, and branding. You receive a personal, non-transferable, non-exclusive licence to use the Services for personal use, subject to these Terms.
12. Service availability and changes
We aim to keep the Services available, but we do not guarantee uninterrupted access. We may update, change, suspend, or discontinue any part of the Services at any time, including for maintenance, security, compliance, or improvements.
13. Disclaimers
To the extent permitted by law, the Services are provided "as is" and "as available". We do not guarantee the Services will be error-free, always available, or that use of the Services will achieve a particular outcome. Results may vary.
14. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or rights you may have under the Australian Consumer Law. Where permitted, our liability is limited to the remedies available under the Australian Consumer Law.
15. Liability
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, loss of data, or business interruption arising from your use of the Services. Where our liability cannot be excluded, it is limited to the minimum extent permitted by law.
16. Termination
You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you have breached these Terms, created risk, or misused the Services.
17. Changes to these Terms
We may update these Terms from time to time. If changes are material, we may provide additional notice (e.g. Website or in-app notice). Your continued use after changes take effect means you accept the updated Terms.
18. Governing law
These Terms are governed by the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts in Queensland.
